Divorce and Separation

Separation and divorce are life changing events that can have a dramatic effect on your emotional and financial wellbeing. It is important to know your rights, obligations, and entitlements if you are going through a separation or divorce. The Court will generally make a Divorce Order where it is satisfied that the marriage has broken down and there is no reasonable likelihood of you and your former partner getting back together. While a divorce order is formal recognition from the Court that your marriage has ended, it is separate and distinct to your property settlement and parenting arrangements. It is important to be aware that proceedings for property settlement and spousal maintenance must be commenced within one year of the divorce. Applications can only be made after this period with the approval of the Court, and this can be difficult to obtain. Divorce proceedings can typically be sought after 12 months of separation from your partner.

Child Support

Child Support can be confusing, and financial support is often an area of concern for many separating parents. While Child Support is generally dealt with by the Child Support Agency, parents may prefer to have a private agreement in place. If you and the other parent already have a private agreement, it is important that your agreement is properly documented to ensure it is contractually binding. We can document your agreement in a Binding or Limited Child Support Agreement to ensure that you get the right result.

Wills, Estates and Powers of Attorney

A will is a legal document which sets out how you want your assets to be distributed on your death. It gives you the opportunity to provide for your family and friends and also lets you choose an executor who will manage your estate after you die. Certain events such as marriage and divorce may affect or invalidate your will. It may also be necessary to appoint a guardian for your children after their birth. If you die and you do not have a will, you are said to die intestate and your estate will be distributed according to a formula set out by the law. You will have no control over how your assets are distributed. Whether you are updating or preparing a Will or Power of Attorney, we can protect you and the people you care about by ensuring your assets are given out according to your wishes.
